LEGAL TERMS AND CONDITIONS OF THE VI PROVI-ART CONTEST
1. PURPOSE
Provital, S.A. – hereinafter PROVITAL – with Tax ID (CIF) A08584997 and registered office at Pol. Ind. Can Salvatella – Gorgs Lladó, 200 – 08210 Barberà del Vallès (Barcelona, Spain) organizes an art competition – hereinafter CONTEST – at national level, aimed at people with disabilities residing in Spain.
The purpose of the CONTEST is to encourage creativity and cultural participation through PAINTING and PHOTOGRAPHY. Participants may submit painting and/or photography works inspired by the theme BEAUTY AND NATURE.
Participation in the CONTEST requires full acceptance of these promotional rules and regulations – hereinafter – LEGAL TERMS.
PROVITAL reserves the right to amend LEGAL TERMS whenever such amendments improve the conduct of the CONTEST and do not substantially affect its spirit.
2. SCOPE AND ELIGIBILITY REQUIREMENTS
The CONTEST is open to individuals legally residing in Spain who hold a valid disability certificate.
Applications that do not meet the requirements established in these LEGAL TERMS will not be eligible to participate.
3. CONTEST TIMELINE
The CONTEST will begin on September 15, 2026, and will close on March 31, 2027.
Entries submitted after the established deadline will not be considered.

Participation in the CONTEST is free of charge.

6. HOW TO PARTICIPATE
6.1. Registration
You must register through the following link, where you will find a REGISTRATION form and a space to upload your artwork in JPG format: weareprovital.com/en/provi-art
A separate form must be completed for each artwork submitted.

Each participant may submit:
• Up to two (2) works in the PAINTING category
• Up to two (2) works in the PHOTOGRAPHY category
The maximum total number of entries is four (4): two (2) paintings and two (2) photographs, including submissions in the Myrtha Casanova (MC) category.
If you become a finalist, you will be asked to provide a copy of your disability certificate.
6.2. Categories
The CONTEST includes the following categories:
• PAINTING
• PHOTOGRAPHY
• Myrtha Casanova (MC)
The MC category is exclusively intended for people who have won a prize in previous editions of the CONTEST.
If you have won a prize in a previous edition, you must register your PAINTING and/or PHOTOGRAPHY works in the MC category.
6.3. Technical Specifications
Each artwork must be created in one of the following sizes:
• Small: 30 x 40 cm
• Medium: 50 x 70 cm
• Large: 70 x 100 cm
2/7 PAINTING works may be created using watercolor, oil, acrylic, mixed techniques, or similar artistic media and must be submitted in JPG format.
PHOTOGRAPHY works must be submitted in maximum-quality JPG format, with a minimum file size of 2 MB and a maximum of 10 MB, and a minimum resolution of 300 dpi.
Only if your work is selected as a finalist will you be asked to physically send it to PROVITAL in one of the dimensions specified above.
Works in other dimensions will not be accepted.
6.4. Awards
PAINTING
• First Prize: € 1,250
• Second Prize: € 750
• Third Prize: € 500
• Fourth Prize: € 250
• Fifth Prize: € 250
PHOTOGRAPHY
• First Prize: € 1,250
• Second Prize: € 750
Myrtha Casanova
• Single Prize: 1.250 €
All participants will receive a participation diploma in recognition of their talent and commitment to this cultural initiative.
The initial selection of the 25 finalist works will be made by PROVITAL employees, with results proportionally distributed according to the number of works received in each category to ensure fairness.
Subsequently, a jury composed of artists, art experts, and representatives of Artistas Divers@s, the City Council of Barberà del Vallès, and PROVITAL will select the 8 winning works.
The results will be announced on September 15, 2027 on the CONTEST website, and winners will be contacted directly. The decision will be final and not subject to appeal.
Prizes will be subject to applicable tax legislation and the legally required withholdings.
No participant may receive more than one prize.
6.5. Award Ceremony and Exhibition
An exhibition of finalist and winning works is planned for November 2027, with the award ceremony taking place on the opening day.
3/7 If your work is selected as a finalist or winner, you undertake to send the original artwork to PROVITAL within two weeks of being notified of your finalist status.
To ensure safe transport, works must be framed with a simple frame. Pieces protected with glass will not be accepted (acrylic glass may be used if necessary). PROVITAL will cover shipping costs.
After the exhibition, PROVITAL will return the artworks to finalists whose works were not awarded.
Participants whose works were not selected as finalists may still exhibit them by sending the original artwork to PROVITAL. In this case, participants will be responsible for shipping and return costs.
PROVITAL shall not be liable for any loss or damage suffered by submitted artworks. Participants may obtain insurance at their own expense.
6.6. Publication and Copyright
Participants grant PROVITAL, on a non-exclusive and royalty-free basis, the rights necessary for the publication, exhibition, reproduction, and public communication of the artwork exclusively in relation to the CONTEST, its exhibition, catalogue, communication activities, and promotion of future editions.
Copyright and intellectual property rights shall at all times remain with the authors.
All finalist works will be included in the CONTEST catalogue, available on the opening day of the exhibition and award ceremony.
Award-winning works will become the physical property of PROVITAL. This transfer applies only to the physical artwork and does not include intellectual property rights, which remain with their authors.
Participants guarantee that they are the authors of the submitted works, that such works are original, and that they do not infringe any intellectual property or third- party rights. Consequently, PROVITAL shall be released from any liability arising from third-party claims concerning authorship or rights over submitted works.
Subject to express consent granted through the REGISTRATION form, artworks may also be displayed on the virtual platform of Artistas Divers@s (www.artistasdiversos.org) to promote and provide international visibility to participants’ work.

7. IMAGES AND AUDIOVISUAL CONTENT
In compliance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 on Data Protection and Digital Rights (LOPDGDD), and Organic Law 1/1982 on the right to honor, privacy, and personal image, PROVITAL requests participants’ express consent to publish or disseminate photographs and videos in which they appear and can be clearly identified, either wholly or partially, for informational, promotional, and publicity purposes related to PROVITAL activities.
Prize winners will transfer all exploitation rights over any audiovisual content generated in which they appear.
If you win a prize, you authorize PROVITAL to use your full name in advertising or promotional activities related to the CONTEST without any additional remuneration beyond the prize received.
This consent will be obtained by selecting the corresponding checkbox in the REGISTRATION form.

8. CONSENT AND DATA PROTECTION
In accordance with Regulation (EU) 2016/679 (GDPR), which was approved in April 2016 and came into force in May 2018, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and of Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), PROVITAL hereby provides the following information in relation to Data Protection:

For what purpose, and on what legal basis, is the data processed?
The legal basis for processing the personal data is the subjects’ participation in the CONTEST:
• To manage the registration, participation and processing of the CONTEST, and to inform the winner.
• For inclusion in audiovisual materials for publication on social and digital media by PROVITAL in such a way that the person can be recognised.
• The data will also be used for the purpose of sending information about future editions of this CONTEST.
The legal basis for processing the personal data is the subjects’ participation in the CONTEST. Processing the data is legitimized by the consent that the participant has given by marking the appropriate box, is as laid down in Article 21 of the Spanish Law on Information Society Services and e-Commerce (LSSI-CE) and Article 6 (1)(a) of the GDPR.
What data is mandatory?
Participants must complete the fields marked with an asterisk (*) as "mandatory" in the registration form, as these are necessary for taking part in the competition. Failure to provide the required personal data, or providing such data only partially, may prevent PROVITAL from accepting that person’s entry, and PROVITAL will therefore be released from any liability for failure to register the participant.
The data provided by participants to PROVITAL must be up to date in order to ensure that the information in our records is accurate and error free. Participants are responsible for ensuring that the details provided are correct.
Who is the data shared with?
The data will be transferred to the Artistas Divers@s association for promoting participants’ work, provided that the partipant has expressly authorised the transfer by marking the corresponding box.
The participant is also informed that he or she can obtain more information about the treatment of the data through the Privacy Policy present on the Artistas Divers@s website: artistasdiversos.org/politica-de-privacidad/
Data will not be disclosed to other third parties unless consent has been granted or disclosure is legally required

How long will the data be kept?
Participants’ personal data will be stored for the duration of the CONTEST and, where applicable, for as long as necessary to comply with the obligations required by law. After this time, the data collected will be duly deleted.
Is the data transferred internationally?
There are no international transfers of the data to third parties outside the European Union.
What are your rights, and how can you exercise them?
You are hereby informed that you may exercise your rights of access, rectification and deletion (right to be forgotten), restriction of processing, data portability and objection, by sending a letter to Provital S.A. with Corporate Tax Code (CIF) No. A08584997 and registered address at Pol. Participants are hereby informed that the mere fact of taking part in the CONTEST entails full acceptance of these LEGAL TERMS. Any statement to the contrary by a participant will result in their exclusion from this competition, and PROVITAL will be released from its obligations to any such participant.
